Thomas (Tom) Nichini

Thomas Nichini is an Associate in the firm's Litigation and Dispute Resolution group, based in the Toronto office. He has a broad commercial and civil litigation practice with a focus on public, Aboriginal and Indigenous law, and appellate-level advocacy. He has represented litigants before the Ontario, Manitoba, and British Columbia Courts of Appeal, the Federal Court of Appeal, and the Supreme Court of Canada.

Mr. Nichini has advised Spotify AB in a judicial-review challenge to the CRTC's new "base contribution" regime under the amended Broadcasting Act, a matter named one of Lexpert's Top 10 Business Decisions of 2024/2025. He has also been counsel in R v. Korduner before the Supreme Court of Canada, a precedent-setting case on the scope of constitutional protections against compelled speech, and acted as counsel in a high-value public authority liability claim relating to a historic miscarriage of justice.

He holds a J.D. and Certificate in Aboriginal and Indigenous Law from Dalhousie University's Schulich School of Law (2023), where he clerked at the Nova Scotia Supreme Court, as well as a Master's Degree in Management and a B.A. in Interdisciplinary Studies from the University of British Columbia.
