Andy Pushalik

Andy Pushalik is a Partner and National Leader of the Employment and Labour group at Dentons, based in the Toronto office. He practices in Employment Law, serving as outside counsel to a wide variety of companies, charities, and public sector organizations across retail, mining, energy, transportation, healthcare, sports and entertainment, media, manufacturing, insurance, and financial services.

Mr. Pushalik advises on sensitive human resources matters, including workplace restructurings, discrimination and harassment complaints, and workplace investigations. He regularly represents employers in all aspects of labour and employment litigation, including wrongful dismissal, grievance arbitrations, and restrictive covenant disputes. He has appeared as lead counsel before all levels of court in Ontario, the Saskatchewan Court of Appeal, the Federal Court of Canada, and administrative tribunals including the Human Rights Tribunal of Ontario, the Ontario Labour Relations Board, and the Canada Industrial Relations Board.

He has advised major clients including a Canadian multinational investment bank on mandatory COVID-19 vaccination policy, Ontario Power Generation and Atura Power on multimillion-dollar power plant acquisitions, Canadian National Railway on labour strikes and injunctions, and a motion picture studio against a certification application. He successfully represented First Uranium Corporation in a change of control severance dispute and a national retailer at trial in defending a wrongful dismissal claim.

Andy holds an LL.B. from the University of Windsor (2006), an LL.M. from the University of Cambridge (2009), and a BBA (Honours) from Wilfrid Laurier University (2003). He previously clerked for the Honourable Mr. Justice Allen M. Linden and the Honourable Mr. Justice John M. Evans of the Federal Court of Appeal. He has been recognized by The Best Lawyers in Canada in Labour and Employment Law, Chambers Canada in Employment & Labour: Ontario, and The Legal 500 Canada as a "Next Generation Partner."
